Distracted driving occurs across all age groups and all modes of transportation, from cars to buses and trucks to trains and is often the cause of serious even fatal accidents. In fact, each year several hundred thousand crashes occur as a result of driver distraction, and thousands of people have lost their lives because of it. And driver distraction comes in many forms - ranging from talking on a cell phone or texting to eating and drinking, interacting with other passengers, daydreaming, or even dealing with strong emotions. If a driver was distracted in any of these ways and causes an accident as a result, he or she could certainly be considered at fault for it and could be held liable to the victims for any injuries sustained. If this situation occurs, the police report should note it, though research shows many drivers do not self-report their distraction. Accordingly to law, a crash investigation may need to be done in order to determine whether driver distraction was involved.
