Aggravated assault is defined as either attacking another or threatening to attack another which would involve severe or aggravated bodily harm. The kind of serious injuries involved include broken bones, lost teeth, internal injuries, loss of consciousness and any unspecified injury requiring two or more days of hospitalization. Aggravated assault is usually associated with the use of a weapon such as a gun, knife, axe or other dangerous instrument, which makes it more likely to cause death or great bodily harm, though a weapon isn't needed in order to be charged with such assault. Also a defendant may be charged with aggravated assault even if no injury results. The mere threat or attempted attack may be enough if done while using a dangerous weapon. Aggravated assault is usually a felony punishable by a prison term.
