Drug testing is a popular legal subject because many people fact it at some point in their lives, and the consequences of a drug test can influence a person's professional and private life. If you work for the government and your job deals with public safety or classified information, you are subject to drug testing. In most cases all new government hires may be tested as a condition of employment. The rights of private employees vary by state but have some commonalities. Most states allow for the testing of new hires as a condition of employment. While some states allow employers to randomly drug test with notice, others quire the employer to have reasonable suspicion of drug use before testing. Reasonable suspicion means the employer must have a legitimate belief of drug use based on both logic and fact. Employers gain reasonable suspicion usually by viewing drug use or by observing a worker's behavior.
