Treble damages is when a court allows a plaintiff to recover up to three times the amount of damages awarded by a jury. Courts are able to increase the amount awarded by a jury where a defendant acted in a prohibited willful way though a court will require substantial evidence proving the defendant’s actions were willful or done in bad faith. There are also statutes that actually rall for treble damages such as RICO violations and antitrust violations.Treble damages are meant to encourage people to sue for violations that are harmful to society in general.
