Punitive damages are viewed as a form of punishment in civil actions intended to deter the defendant and others from engaging in similar conduct that caused the plaintiff’s harm. Punitive damages are often awarded when compensatory damages are not seen as sufficient to compensate the plaintiff for the damage done to them. Punitive damages do not coincide with provable injuries and are generally only awarded in special circumstances. As a rule of thumb, punitive damages are not awarded in breach of contract cases.
